bob redell joins us live with the new details. good morning, bob. >> reporter: good morning to you, laura. his family, who lives here in this neighborhood in san jose, has already headed down for palm springs. this is where the marine sop, 22-year-old allan devillena was killed by police early saturday morning. two bicycle police officers were responding to loud voices in a parking garage. they recognized devillena from a earlier drunk in public incident. when they ordered him and his passenger out of the car, police say the marine drove off, hitting one of those officers, while the other officer hung out of the passenger window. that's when police fired their weapons, hitting and killing the young marine. his father says -- we spoke with him, doesn't think his 22-year-old son would have started a confrontation with police. he says he was smarter than that. >> he was very close with his sisters, his cousins, very close to family. he's got a lot of friends, very popular. >> reporter: his friend was not hurt inside his car. police s
